Terms of Service

These Terms of Service ("Terms") govern your use of the MotoHeads app and website at https://motoheads.in (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old to use MotoHeads. By using the Service you represent and warrant that you are 18 or older and legally able to enter into these Terms.

When you sign in, you explicitly confirm that you are 18 or older and that you accept these Terms and our Privacy Policy by ticking the acknowledgement before you request a login code.

2. Your account

You log in using an email one-time password (OTP). You are responsible for:

• keeping access to your registered email address secure;
• all activity that occurs under your account;
• providing accurate information and keeping it up to date; and
• notifying us promptly at support@motoheads.in if you suspect unauthorised use of your account.

3. Acceptable use

You agree to use MotoHeads lawfully and respectfully, and to follow our Community Guidelines. You agree not to:

• harass, threaten, abuse, or incite violence against others;
• post hate speech or content that discriminates against any person or group;
• post spam, scams, or misleading commercial content;
• post nudity, sexually explicit material, or content that sexualises minors;
• post illegal content or content that promotes dangerous or illegal riding (for example, encouraging others to break traffic laws);
• impersonate any person or misrepresent your identity;
• attempt to access, disrupt, or reverse-engineer the Service or its security; or
• infringe the intellectual-property or privacy rights of others.

4. Your content and licence

You retain ownership of the posts, photos, videos, comments and messages you create ("User Content"). By posting User Content, you grant MotoHeads a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content solely for the purpose of operating and providing the Service (for example, showing your post in the Discover feed or your crew's chat). This licence ends when you delete the content or your account, except for content already shared with others or retained in backups for a limited period.

You are solely responsible for your User Content and confirm you have the rights to post it. We may remove content that violates these Terms or our guidelines.

5. MotoHeads is a platform, not a ride organizer

Any ride you take part in is at your own risk and your own responsibility. Please read our Rider Safety & Liability page before joining any ride.

6. Fees

MotoHeads is currently free to use. We may introduce premium features in future. If we do, any paid features and their pricing will be clearly described, and payments would be handled by Google Play.

7. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content posted by users is accurate, safe, or reliable.

8. Limitation of liability

To the maximum extent permitted by law, MotoHeads and its founder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from: (a) your use of, or inability to use, the Service; (b) any ride, meet-up, event, or interaction arranged through the Service; (c) the conduct or content of any user; or (d) any accident, injury, loss, damage, or dispute connected with riding. Rides and all riding activity are undertaken entirely at your own risk.

9. Termination

You may stop using the Service and delete your account at any time (see Account Deletion). We may suspend or terminate your access if you breach these Terms, our guidelines, or applicable law, or to protect the community or the Service.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date and, where appropriate, notify you in the app. Continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of India, and you agree to the exclusive jurisdiction of the courts of India for any dispute arising from them.
